Relocating with children

Making arrangements for children after divorce or separation can be tricky. Even more so if one parent wants to move away – within the UK or abroad – or is worried their former partner will relocate with the children against their wishes.

The most important people involved in this process are the children. Whether you’re looking to relocate or block a move, you’ll need to present a compelling case that it’s the right thing for the child or children involved. Most critically, you need to show they’ll maintain a relationship with their other parent, as well as showing the impact on their education and their physical and emotional needs.

Courts will always prioritise the child’s welfare in making any decisions. Where decisions are time-sensitive, we often recommend using arbitration – a privatised version of the court process where an experienced and specially trained barrister takes the place of a judge.
