Eri Horrocks, Associate in our Family & Relationships department, outlines the urgent steps that can be taken when a partner unilaterally removes children without consent.

Drawing on insights from a workshop led by Simon Craddock and Laura Morley, the session explored a range of emergency private children scenarios, from local removals to international abductions. Depending on the circumstances, responses may include issuing a letter before action, applying for court orders (with or without notice), and involving the police or border authorities.

The workshop also covered key legal tools such as section 8 orders, return orders, port alerts, and Tipstaff orders, offering a practical roadmap for navigating these high-stress situations.

The importance of acting swiftly and appropriately was underscored, particularly in avoiding missteps that could lead to costs orders against legal representatives. Anecdotal tips included engaging local counsel in cross-border cases and contacting embassies to prevent passport issuance.

The session emphasised the need for careful legal strategy and preparation, supported by comprehensive resources and guidance, to protect children’s welfare and ensure effective legal recourse in emergency situations.
