Business occupiers may find their needs being met by the grant of a new lease – maybe a building lease – or the assignment, or underletting, of an existing lease. Occupiers of commercial property have differing legal requirements, but all need to be sure that their business is not restricted by the lease, that they are not over-committing themselves, and that the terms on offer cannot be improved upon.

For occupiers taking new build freeholds advice on the documentation of robust and enforceable development obligations will be required. Where an occupier’s requirements change after a lease has been taken, then an assignment of the lease, underletting of surplus space, altering the let premises or even surrendering the lease may be options.

We advise occupiers in these respects having regard to the statutory and technical constraints applying to the occupation and use of business premises.
