Clare Brennan, Partner in our Corporate & Commercial team, explores the growing challenges employers face in supporting neurodiverse employees while meeting their legal obligations under the Equality Act 2010.

As awareness of conditions such as ADHD, autism, anxiety and Tourette’s continues to rise, employers are increasingly required to consider how best to support individuals in the workplace. 

Clare highlights that a formal diagnosis is not required for an employee to bring a disability discrimination claim, creating additional complexities for businesses. She notes that employers cannot simply claim ignorance of a disability, particularly where signs of neurodiversity may be less visible or harder to identify. 

Against this backdrop, disability discrimination claims linked to neurodiversity are increasing, with Employment Tribunal cases involving ADHD and autism becoming more common. The article examines the legal and practical challenges employers face when responding to requests for reasonable adjustments and creating inclusive working environments. 

Clare emphasises that there is no universal solution when it comes to supporting neurodiverse employees. An adjustment that works well for one individual may not be suitable for another, making open communication, flexibility and a tailored approach essential for businesses seeking to balance the needs of employees, colleagues and the wider organisation.
